1. Acceptance of Terms

By registering for, attending, or participating in any class, camp, workshop, event, or program offered by Art Factory Studios (“Programs”), or by accessing our website hosted by Wix, you agree to be legally bound by these Terms of Service.

If registering a minor, you represent that you are the child’s parent or legal guardian and have authority to agree to these Terms on the child’s behalf.

2. Assumption of Risk

Participation in art studio activities involves inherent risks, including but not limited to:

  • Minor cuts, burns, slips, or falls

  • Exposure to art materials

  • Kiln equipment and tools

  • Accidental property damage

You voluntarily assume all risks associated with participation in AFS Programs.

3. Release and Waiver of Liability

To the fullest extent permitted under California law, you release and hold harmless Art Factory Studios, its owners, employees, contractors, agents, and affiliates from any and all claims, liabilities, damages, losses, or expenses arising out of participation in Programs, except in cases of gross negligence or willful misconduct.

4. Medical Authorization

In the event of a medical emergency involving a student, AFS may attempt to contact the parent/guardian or emergency contact.

If contact cannot be made, you authorize AFS to obtain emergency medical treatment deemed necessary and agree to assume full financial responsibility for any resulting costs.

5. Health & Illness Policy

Students must not attend Programs while ill. AFS reserves the right to deny attendance to any participant displaying symptoms of illness.

Parents/guardians agree to promptly disclose contagious illness exposure when known.

6. Payment Terms

Payments may be processed via:

  • Stripe

  • Sawyer

Payment obligations include:

  • Tuition due on the first day of each calendar month

  • $20 late fee for overdue payments

  • 30 days written notice required for withdrawal from ongoing classes

  • Continued billing during required notice period

AFS reserves the right to:

  • Deduct up to 4% from refunds to recover non-refundable credit card processing fees

  • Refuse service for unpaid balances

Chargebacks or payment disputes initiated without first contacting AFS may result in permanent dismissal from Programs and recovery efforts for associated fees.

7. Refund and Cancellation Policy

Camp cancellation terms:

  • $50 administrative fee for cancellations 30+ days prior

  • 50% refund 14–29 days prior

  • No refunds within 14 days

No refunds are provided for missed classes or dismissal due to behavioral violations.

AFS reserves the right to cancel or reschedule Programs due to circumstances beyond its control.

8. Code of Conduct

AFS maintains a safe and respectful environment. Prohibited conduct includes:

  • Harassment or threatening behavior

  • Abusive communications

  • Disruption of studio operations

  • Social media defamation

  • Aggressive or unsafe conduct

AFS reserves the right to dismiss any participant or parent for violation of these standards without refund.

9. Photography & Media Release

By participating in AFS Programs, you grant AFS the irrevocable right to use photographs, video, and audio recordings for lawful promotional and educational purposes without compensation.

You waive the right to inspect or approve finished materials.

Opt-out requests must be submitted in writing to info@artfactorystudios.com prior to participation.

10. Intellectual Property

All curriculum materials, class content, branding, logos, and website materials are the intellectual property of Art Factory Studios and may not be reproduced without written consent.

11. Indemnification

You agree to indemnify, defend, and hold harmless Art Factory Studios from any claims, damages, liabilities, costs, or expenses (including attorney’s fees) arising from:

  • Your breach of these Terms

  • Your misconduct

  • Your child’s conduct

  • Violation of any law or third-party rights

12. Limitation of Liability

To the maximum extent permitted by law:

AFS’s total liability for any claim shall not exceed the total amount paid by you to AFS in the 3 months preceding the claim.

AFS shall not be liable for indirect, incidental, consequential, or punitive damages.

13. Dispute Resolution & Arbitration

Any dispute arising out of or relating to these Terms or participation in Programs shall be resolved through binding arbitration in Monterey County, California, in accordance with the rules of the American Arbitration Association.

Each party shall bear its own legal fees unless otherwise required by law.

You waive the right to participate in class action litigation.

14. Governing Law & Venue

These Terms are governed by the laws of the State of California.

If arbitration is found unenforceable, disputes shall be resolved exclusively in the state or federal courts located in Monterey County, California.

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

16. Modifications

AFS reserves the right to update these Terms at any time. Continued participation after updates constitutes acceptance of revised Terms.
